Elworth, Sandbach – 4 dwellings

Emery Planning obtained planning permission in June 2014 for the demolition of a former retail unit and its replacement with four dwellings in Vicarage Lane, Elworth.

Despite the appeal site being located in a predominantly residential area with houses of a varying size and design, the Council refused the scheme as it was considered to be out of keeping with the area due to the height, size and scale of the proposed houses. All separation distances to adjacent properties were adequately met and the Inspector considered that the scheme would not have an adverse impact upon living conditions of the occupiers of these dwellings.

The Inspector also stated that the loss of the previous retail use on site was not a matter for consideration and furthermore, an employment use would not be suitable in this residential context. Furthermore, they did not consider that the Council had provided adequate explanation for the reason for refusal when claiming that the scheme would be detrimental to the character and appearance of the area. Consequently, full costs were awarded against the Council.

Prior to the appeal decision being issued, a revised scheme for three dwellings on the site was approved.
